1. Acceptance of Terms
Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Academix application and ELMS web services (collectively, the "Service") operated by Infologic International Pvt. Ltd. ("Company", "We", "Us", or "Our").
Your access to and use of the Service is conditioned upon Your acceptance of and compliance with these Terms. These Terms apply to all visitors, educational administrators, teachers, students, parents, and others who access or use the Service.
Binding Agreement
By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of the Terms, then You may not access the Service.
2. Definitions
For the purposes of these Terms and Conditions:
Means a unique authenticated account created for You to access the Service or specific portal modules.
Refers to Academix, the mobile software program provided by the Company on Android and iOS.
Refers to Infologic International Pvt. Ltd., located at Sanepa-2, Lalitpur, Nepal.
Refers to Nepal.
Means any device that can access the Service, such as a desktop PC, laptop, cellphone, or digital tablet.
Refers collectively to the Academix Application and the ELMS Website or both.
Means the individual accessing or using the Service, or the educational institution on behalf of which such individual is accessing the Service.
3. Accounts & Credential Responsibility
When You create an account with Us, You must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.
You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a third-party service.
You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.
4. Use of Camera Permissions
Our Application (Academix) may request access to Your device’s camera to provide essential academic functionality:
- Instant scanning of student & staff ID cards and examination admit cards via QR code.
- Direct photo capture of completed student assignments, homework, and signed permission slips.
- Verified profile photo capture for student identity management.
Privacy Governance
By granting camera permission, You agree to the collection and use of camera data strictly in accordance with Our Privacy Policy. You may disable camera access at any time through Your device settings.
5. Content & Intellectual Rights
You are responsible for the content that You post to the Service, including its legality, reliability, and appropriateness. By posting content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content solely for the purpose of operating the Service.
You retain any and all of Your rights to any curriculum, lesson notes, and administrative media You submit, post, or display on or through the Service, and You are responsible for protecting those rights.
6. Prohibited Activities
You agree not to use the Service to:
- Engage in unlawful, fraudulent, defamatory, or abusive behavior.
- Transmit or distribute viruses, malware, trojans, worms, or other harmful malicious payloads.
- Violate the intellectual property, copyright, or privacy rights of any school, student, or educator.
- Collect or harvest personal contact information of students or parents without express authorization.
- Engage in unauthorized penetration testing, denial of service (DoS), or disruptions to cloud servers.
7. Termination
We may terminate or suspend Your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your account, You may discontinue using the Service or request account decommissioning through your school administration.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service.
- Any conduct or content of any third party on the Service.
- Unauthorized access, use, or alteration of Your transmissions or content.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
10. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after revisions become effective, You agree to be bound by the revised Terms. If You do not agree to the new terms, You are no longer authorized to use the Service.
